Distance Sales Agreement

DISTANCE SALES CONTRACT

1. PARTIES

This Agreement; on the one hand,

On the other hand, it has been concluded between the BUYER (person/organization whose name-surname/title, address, e-mail, telephone information is declared at the payment/order stage) who places an order through the SELLER's website, with the following terms and conditions.

By confirming the order, the BUYER agrees to pay the product price, shipping, taxes and other costs (if any).


2. DEFINITIONS

Goods : Refers to all kinds of products offered by the SELLER.


TOPIC 3

It is the determination of the procedures and principles regarding the sale and delivery of the product/products that the BUYER orders electronically through the SELLER's Site, the qualities and sales price of which are specified on the order screen.

5. BUYER INFORMATION

The person/title to be delivered, delivery and invoice address, telephone and e-mail are based on the information declared by the BUYER at the ordering stage.


6. CONTRACTUAL PRODUCT / PAYMENT / DELIVERY

The BUYER acknowledges that he/she has read and electronically confirmed the preliminary information regarding the basic characteristics of the products, sales price, payment, and delivery terms. Prices announced on the website are valid until updated; limited-time campaigns are valid for the duration of the campaign.

Total sales price (including taxes), shipping cost (if any), payment method and plan, invoice and delivery information are included in the order summary and approved by the BUYER.

Delivery: Product(s) will be delivered to the BUYER or the person/organization they designate, within the maximum period specified in the preliminary information, depending on the BUYER's location, depending on stock and production status. The shipping fee will be determined on the order screen.
Invoice: It is issued electronically as an e-invoice/e-archive; otherwise, a physical invoice is delivered.


7. GENERAL PROVISIONS

7.1. The BUYER accepts, declares and undertakes that he/she has read and is informed about all preliminary information regarding the basic qualities of the products, sales price, payment method and delivery information before order confirmation and that he/she has confirmed this preliminary information electronically.
7.2. SELLER agrees to deliver the product subject to the contract in accordance with the specifications specified in the order, without defects and in accordance with the legislation.
7.3. In the event of force majeure or extraordinary circumstances preventing performance, the SELLER shall notify the BUYER of the situation; the BUYER may cancel the order, request a replacement with a similar one, or postpone delivery. In the event of cancellation, the BUYER's payments will be refunded within 14 days.
7.4. If the BUYER fails to make payment or the payment is cancelled by the bank/payment institution, the SELLER's delivery obligation ends.
7.5. If the price is not paid to the SELLER due to the illegal use of the credit card by unauthorized persons after the delivery of the product, the BUYER agrees to return the product to the SELLER within 3 days.
7.6. The BUYER checks the product before delivery; damaged/damaged packages or products must be recorded in a report by the courier and must not accept the delivery. The product received is deemed undamaged.
7.7. SELLER may send information and commercial electronic messages to BUYER through the contact information shared with BUYER during order/membership; BUYER may exercise its right of rejection at any time.
7.8. The BUYER accepts that the personal information provided during membership or ordering is accurate, and that otherwise he/she will be personally responsible for any damages that may arise.
7.9. The BUYER is obliged to act in accordance with all applicable legal regulations and general morality while using the Site.
7.10. Links to third-party websites may be provided through the Site. These links are provided for ease of navigation and do not constitute any commitment or warranty on the part of the SELLER.
7.11. The BUYER accepts that he/she gives permission for the SELLER to contact him/her through the contact information provided before the order.

7.12. Return/Cancellation Limit for Made-to-Measure/Custom-Made Products
There is no right of withdrawal pursuant to Article 15/1-ğ of the Distance Contracts Regulation for products produced/measured in line with the BUYER's requests or personal needs (e.g. pleated curtains, pleated fly screens, accordion doors, caravan curtains, roller/zebra/jalousie/tulle curtains, etc. produced according to selections such as size, color, profile, mechanism, installation type, combination). Return/cancellation of such products is only possible in the following cases:
a) Damage caused by transportation: The BUYER's optional rights apply to damages occurring during transportation, provided that a report is kept with the courier at the time of delivery and the damage is immediately reported to the SELLER. Damage caused by external impacts/misuse after delivery is not covered.
b) Non-conformity to the contract/defect: If the product is clearly defective or contrary to the size-configuration-model information approved by the BUYER, the BUYER may use its optional rights arising from the Law (refund, free repair, replacement with a defect-free equivalent or price reduction in proportion to the defect).
c) Wrong product shipment: If a product other than the one ordered has been sent, the product must be reported to the SELLER to be returned unused and with all its accessories/packaging.

The following situations are not considered as reasons for return/cancellation:

  • Error in the BUYER's measurement declaration or fault of the BUYER/third party during assembly,

  • Reasonable visual differences such as tone/colour differences due to screen/device settings,

  • Damages resulting from use contrary to the instructions for use, storage or cleaning.

If the situations specified in clauses (a) and (b) are detected, the SELLER may firstly choose to have the defect repaired/re-manufactured free of charge ; if this is not possible, the BUYER's other optional rights shall apply.


8. RIGHT OF WITHDRAWAL

8.1. If the distance contract is related to the sale of goods, the BUYER may exercise his right of withdrawal within 14 days from the date of delivery of the product to him or to the person he has indicated, provided that he notifies the SELLER.
8.2. Important: There is no right of withdrawal for products produced/measured in line with the BUYER's requests or personal needs (Regulation Art. 15/1-ğ).
8.3. The notice of withdrawal must be made in writing or by permanent data storage within the specified period. Upon receipt of the notice of withdrawal, the product must be returned complete with its invoice and all accessories.
8.4. The price of the returned product will be refunded to the BUYER in the same way as the payment was made within 14 days from the receipt of the notice of withdrawal. SELLER is not responsible for delayed reflections by the bank.


9. PERSONAL DATA AND PRIVACY

Personal data is processed in accordance with Personal Data Protection Law No. 6698 and relevant legislation. Details are explained in the "Privacy and Security Policy" and "Cookie Policy" pages.


10. DEFECTIVE GOODS / WARRANTY / SERVICE

If the product is found to be defective, the BUYER may exercise his/her legal rights (refund, free repair, price reduction proportional to the defect, replacement with a defect-free equivalent).


11. DISPUTE RESOLUTION

In disputes arising from consumer transactions, the Consumer Arbitration Committee/Consumer Courts located in the BUYER's place of residence or the place where the transaction took place have jurisdiction. The application monetary limits are determined according to the amounts announced annually in the Official Gazette.


12. ENFORCEMENT

By confirming the order on the Site, the BUYER accepts all the terms of this Agreement.
SELLER provides software arrangements to prove that BUYER has read and approved the contract before the order is completed.
